The following Terms and Conditions apply to all persons attending, or participating in any tour organised by South Coast Bike Tours: ABN 41 646 761 935
You acknowledge that you have read and agreed to these Terms and Conditions before purchasing a ticket to the tour.
Your payment of the initial deposit/booking fee for your chosen bike tour indicates your acceptance of these Terms and Conditions. If you have any questions or concerns, please contact us before making a booking...
If you do not abide by the Terms and Conditions, you will be asked to leave the activity and there is strictly no refund of ticket purchase.
South Coast Bike Tours reserve the right to amend these Terms and Conditions at any time without prior notice. Any changes to these Terms and Conditions will be posted on our website and will apply to all bookings made after the date of posting.
Acknowledgements and Warranty of Participant
You, as participant of your chosen tour acknowledge and warrant the following:
1. A detailed contract containing your acknowledgment of warning, waiver agreement, release and consent for participating in a dangerous activity, indemnity and declaration is required to be signed prior to commencing the tour. Failure to sign this contract will result in exclusion from the tour. A copy of your contract is available by request to South Coast Bike Tours at any time prior to the tour;
2. You hold a valid license to operate the motorcycle you are using on this tour and that you agree to produce a copy to South Coast Bike Tours for verification at the pre-tour safety briefing;
3. Motorcycle riding is a dangerous activity that may result in your serious injury or death, and/or damage to property and you fully accept these risks;
4. You possess sufficient skills required to safely control your motorcycle in challenging off-road terrain;
5. You are solely responsible for keeping your motorcycle under control, riding at appropriate speeds and adhering to all state laws;
6. You have sufficient safety clothing and equipment (including an Australian Standards approved safety helmet) suitable for this type of tour and will use these items at all times during the tour. South Coast Bike Tours reserves the right to refuse participation if it deems any unsafe equipment is in use by you before and during the tour;
7. You will not take control of your motorcycle whilst under the influence of alcohol or drugs. South Coast Bike Tours reserves the right to suspend or terminate participation if it deems you are affected by alcohol or drugs at any time;
8. You will notify South Coast Bike Tours of any accident or incident that may occur during the tour;
9. You have obtained sufficient accident insurance cover reflective of the nature of the activities undertaken on this tour as recommended by South Coast Bike Tours;
10. You have been provided a copy of the South Coast Bike Tours Privacy Policy and acknowledge that they will collect your personal information in order to conduct the tour and in the event that medical treatment is required, you acknowledge that sensitive health information may be collected to the extent necessary to arrange appropriate medical treatment;
11. You agree that South Coast Bike Tours can use your name, likeness, image and/or voice (including photographs and/or film recordings) in any media for an unlimited time for the purpose of promoting the event or tour. No remuneration will be paid for any use as stipulated; and
12. When entering National Parks, you agree to abide with all applicable legislation and accompanying regulations.
Ticket Policy
By purchasing a ticket for a tour organised by South Coast Bike Tours you are agreeing that you have read these Terms and Conditions, and you agree to abide by them.
Booking and Payment
To make a booking with South Coast Bike Tours, you must be at least 18 years of age.
A non-refundable 20% deposit/booking fee is required to secure your booking. The amount of the deposit will be specified at the time of booking. Balance of all fees pertaining to the selected tour must be paid no later than 14 days before the tour start date.
Payments can be made by credit card or bank transfer. If the full payment is not received by the due date, we reserve the right to cancel your booking and retain your deposit.

Cancellation and Reschedule Policy
South Coast Bike Tours reserves its rights for any reason and without prior notice to:
1. Refuse any participant at any stage of the tour for non-compliance of these terms, or for non-compliance of any instructions given throughout the tour. Under such circumstances, no refund of any fees will be made.
2. Reschedule the tour at their sole discretion, noting that each tour must have a minimum of eight (8) participants.
3. Cancel the tour and refund any tour registration fee paid by you to participate in or attend the tour. Circumstances that may see the tour cancelled are any conditions that the South Coast Bike staff deem at their sole discretion unsafe for the tour to continue. These include, but are not limited to fire, storm, rain, floods, or unsuitability of conditions at the tour location and surrounding area.
4. Without limitation any payment to you for any cancellation of the tour is limited to a maximum of the amount paid by you to South Coast Bike Tours. South Coast Bike Tours accepts no responsibility or liability for any other additional costs incurred by you in relation to your participation or attendance of any tour that is subsequently cancelled subject to the refund of any tour registration fee to you as set out above.
Refund Policy
1. If you need to cancel your tour, you must do so in writing via email. If you cancel your booking your deposit and additional fees paid will not be refunded. For the avoidance of doubt your inability to attend any rescheduled tour will not entitle you to any refund.
2. At their sole discretion, South Coast Bike Tours will reschedule your attendance at an alternate tour.
Code of Conduct
By entering, attending, or participating in the tour you agree to abide by the following codes of conduct:
1. Listen and follow all lawful directions of your tour guide.
2. Be aware of and act within the rules of the tour.
3. Show respect and courtesy to all involved with the tour.
4. Display appropriate and responsible behaviour in all interactions.
5. Act with integrity and objectivity and accept responsibility for your decisions and actions.
6. Ensure your decisions and actions contribute to a safe environment.
South Coast Bike Tours reserves all rights to refuse participation or continued participation to the tour at its sole discretion, with or without cause, including if you are deemed to be intoxicated and/or disorderly, or if you do not comply with the Code of Conduct, or if you refuse to comply with lawful directions made by the South Coast Bike Tours staff.
Disclaimer Exclusion of Liability, Release, and Assumption of Risk
In consideration for being able to attend or participate in the tour, you agree:
1. You are 18 years of age or older and hold a current motorcycle licence.
2. You attend and participate in the tour at your own risk.
3. South Coast Bike Tours and the Associated Entities do not make any warranty, implied or express, that any services provided at the Tour/Event will be provided with due care or skill or that any materials or property provided in connection with the Event will be fit for the purpose for which they are supplied.
4. You release South Coast Bike Tours and any promoters, media partners, sponsor organisations, land owners and lessees, organisers of the Tour/Event their respective servants, officials, representatives and agents (collectively, the “Associated Entities”) from all liability for your death, personal injury (including burns), psychological trauma, or other loss or damage (including property damage) (“harm”) howsoever arising from your participation in or attendance at the Tour/Event (including harm arising from the negligence of South Coast Bike Tours and/or the Associated Entities), except to the extent prohibited by law.
5. Your participation, motorcycle and your property is not covered by any insurance policy maintained by South Coast Bike Tours or any policy other than the policy that you have taken out for yourself.
6. You accept the conditions of, and acknowledge the risks arising from, attending or participating in the tour and being provided with the tour services by South Coast Bike Tours and the Associated Entities.
General Risk Warnings
1. You acknowledge that motorcycle riding is an inherently DANGEROUS recreational activity and that regardless of the precautions which you might take, you are exposed to significant risk of property damage, physical harm, disability, or death.
2. If you do not wish to be exposed to such risks, then you must not participate in the tour.
3. You acknowledge that the risks associated with attending or participating in the tour include, without limitation, the risk that you may suffer harm as a result of:
a. People, motorcycles, motor vehicles, equipment, or property (or parts of) colliding with other persons, motorcycles, motor vehicles, equipment or property;
b. Other participants acting dangerously or with lack of skills; and
c. High levels of noise exposure.
Insurance
South Coast Bike Tours strongly recommend that you purchase comprehensive travel insurance policy to covers motorcycle tours and any unforeseen circumstances that may occur. It is your responsibility to ensure that you have adequate insurance and ambulance coverage for your trip.
Personal items including motorcycle and equipment
You agree that you bring your personal items, including your motorcycle and equipment at your own risk and South Coast Bike Tours will not be held responsible for any damages to, loss or theft of personal items, including your motorcycle and equipment.
Restricted / Prohibited Items
The following items are not permissible on the tour:
1. Illicit drugs and alcohol.
2. Flares, fireworks, laser pointers, firearms, dangerous weapons, or any device that has the potential to cause injury or public nuisance.
Images and Recordings
1. You consent to the recording of your image or likeness including audio and visual.
2. You acknowledge that you may be photographed and/or filmed during the tour. South Coast Bike Tours may create, record, transmit, reproduce, and use visual and audio-visual footage (“Recordings”) and still images (“Images”) of you at or in relation to the tour.
3. You grant South Coast Bike Tours permission to use Recordings and Images in any media, worldwide and for any purpose without identification, compensation, or payment of any kind.
4. If you do not wish to be photographed or filmed for these purposes, you must advise South Coast Bike Tours.
Your Privacy
1. South Coast Bike Tours collects personal information within the meaning of the Privacy Act 1988 about you which is necessary for it to operate the tours.
2. South Coast Bike Tours may collect your name, address, email address and phone number for the purposes of arrangements at the tour and to conduct research, marketing and promotional activities in relation to the tour.
3. South Coast Bike Tours may also collect your health information when arranging medical care for you.
4. Unless you advise South Coast Bike Tours otherwise, you consent to receiving future promotional and marketing material from South Coast Bike Tours and its sponsors and partners, including news, offers, products and services you might be interested in, by any medium, including telephone, email, mail, SMS or online marketing.
Food
South Coast Bike Tours may provide food and drinks on specific tours and are not liable for any adverse effects of food and drinks consumed by you. South Coast Bike Tours are not required to cater for specific food preferences, intolerances or allergies. Food and drinks are consumed at your own risk.
Website and Social Media
1. South Coast Bike Tours may change the content on its website, including the "Terms and Conditions" at any time and without notice. The date will always be displayed on our "Terms and Conditions" page when an update has been made.
2. All material used on our website including registered trademarks, logos, domain names, company and business names, photographs and designs are owned exclusively by South Coast Bike Tours.
3. All content on South Coast Bike Tours website and social media cannot be used for media use without our written permission.
4. If there is a "Share" option, pictures, videos, and other content may be shared to your personal social media accounts.
Handling of enquiries, general concerns and complaints
1. If you have enquiries, general concerns or complaints about these Terms and Conditions, or about South Coast Bike Tours behaviour in relation to the Terms and Conditions, you undertake to communicate them in the first instance with them in writing with sufficient detail.
2. South Coast Bike Tours agrees to promptly acknowledge of the receipt your communications and provide a response to the communication, in an appropriate and meaningful manner within a reasonable time period.
